These Terms of Use (“Terms”) are a legal agreement between you and SmileMax AI (“SmileMax,” “we,” “us”) for use of the SmileMax AI mobile application and website at smilemax.net.
By downloading or using SmileMax AI, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the app.
Licensed Application End User License Agreement: where Apple’s standard EULA applies in addition to these Terms, see Apple’s Licensed Application End User License Agreement. If there is a conflict about App Store distribution rules, Apple’s terms for end users control for those topics.
1. The service
SmileMax AI provides cosmetic smile appearance scoring and wellness-style habit suggestions based on photos you submit. Results are informational and subjective.
Not medical care. SmileMax is not a medical device and does not provide dental, medical, or orthodontic advice, diagnosis, or treatment. Always consult a licensed dentist or healthcare professional for oral health concerns.
2. Eligibility
You must be old enough to consent to these Terms in your country (and at least 13, or the age required by Apple in your region). You are responsible for compliance with local laws.
3. License
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use SmileMax AI on Apple devices you own or control, as permitted by the App Store usage rules.
You may not copy, modify, reverse engineer, rent, sell, or misuse the app, or attempt to bypass technical limits, except where prohibited restrictions are not allowed by law.
4. Your content & photos
- You retain rights to photos you submit.
- You grant us a limited license to host, process, and display them as needed to provide analysis and history in the app.
- You confirm you have the right to upload the photos and that they do not violate others’ privacy or rights.
- You can delete stored scan data as described in the Privacy Policy.
5. SmileMax Pro subscriptions (App Store)
Optional auto-renewable subscriptions unlock Pro features (such as full tips, personalized routines, and related unlocked content). Product and pricing shown in the app at purchase time control.
- Payment: Charged to your Apple ID account at confirmation of purchase.
- Renewal: Subscription automatically renews unless cancelled at least 24 hours before the end of the current period.
- Renewal charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current rate.
- Management: Manage or cancel in iOS Settings → [Your Name] → Subscriptions, or as Apple otherwise provides.
- Trial (if offered): Any unused portion of a free trial is forfeited when you purchase a subscription, where allowed by Apple.
- Refunds: Handled by Apple under Apple’s refund policies. Contact Apple Support for billing refunds.
Deleting the app or deleting in-app data does not cancel your subscription.
6. Acceptable use
You agree not to:
- Use SmileMax for unlawful purposes or to harm others.
- Upload illegal, abusive, or non-consensual images.
- Attempt to disrupt servers, scrape at scale, or misuse AI endpoints.
- Represent SmileMax results as a clinical diagnosis.
7. Intellectual property
The app, branding, UI, and original content (excluding your photos) are owned by SmileMax or its licensors. Feedback you send may be used to improve the product without obligation to you.
8. Third-party services
The app relies on third parties (including Apple, RevenueCat, hosting providers, and AI processing providers). Their terms and privacy policies apply to their services.
9. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that scores will be accurate, complete, or suitable for any decision.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMILEMAX AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50 — EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
11. Termination
You may stop using the app at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the service. Sections that by nature should survive (including disclaimers, liability limits, and subscription terms already billed) will survive.
12. Changes
We may update these Terms by posting a new version on this page. Material changes may also be communicated in the app where practical. Continued use after the effective date means you accept the updated Terms.
